Terms and conditions of sale LaCompagniedesCartes.fr, updated July 19, 2019

The merchant site named "La Compagnie des Cartes" (hereinafter referred to as the "site") is an e-commerce site accessible via the Internet network, primarily at the web addresses lacompagniedescartes.fr or lacompagniedescartes.com. The site is the exclusive property of the company Moose Crossing SARL, which designs, develops, publishes and updates it.

The site is hosted by Shopify.

The company Moose Crossing is a SARL with a capital of 10,000 euros, registered in the Bordeaux trade and companies register under the number 527 910 327, whose intra-community VAT number is FR62527910327, and whose head office is located at 18, chemin de la Briqueterie in Canéjan (33610, France).

The site offers for sale, in their printed or electronic (dematerialized) form, road maps, hiking maps, travel maps, travel guides, books, accessories produced by other companies (publishers or manufacturers).

Any order of a product offered on the site implies the Buyer's adherence to these general conditions of sale, which are those in force at the date of order. These general conditions of sale are governed by French law, and only the French courts have jurisdiction in case of dispute.

Moose Crossing SARL reserves the right to modify at any time these general conditions of sale by updating them on the site.

Article 1 - Guarantees

 

Information relating to legal guarantees according to the methods indicated by Article L.211-2 of the Consumer Code and by the Order of December 18, 2014:

  • When the consumer acts in legal guarantee of conformity, he has a period of two years from the delivery of the goods to act;
  • He may choose between repairing or replacing the good, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code (if neither of these solutions is effective within one month from the date of the consumer's complaint, the consumer may demand a refund);
  • He is exempted from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is increased to twenty-four months from March 18, 2016, except for second-hand goods;
  • This same box reminds us that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted;
  • It reminds, finally, that the consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

Moose Crossing SARL guarantees the buyer for hidden defects in the thing sold that make it unfit for the purpose for which it was intended, or that so diminish its use that the buyer would not have acquired it or would have given only a lesser price if he had known about them.

Moose Crossing SARL will bear the full cost of returning the product(s) concerned.

Moose Crossing SARL has an after-sales service, which the customer can contact at the contact information indicated in Article 4.

Article 2 - Products - Prices

Only the products listed on the site on the day of its consultation by the customer are offered for sale. Product offers are limited to the countries available in the delivery address fields. The offers of products and prices are valid, within the limit of available stocks, as long as they are visible on the site.

The descriptions, characteristics and photographs of the products are made with all the possible care, taking into account the competences which Moose Crossing SARL has, and this in order to give to the customer the best possible information on the product(s) which he wishes to buy.

The prices are indicated in Euros inclusive of all taxes (TTC). The value added tax (VAT) is the one in force on the French territory. The applied prices are those appearing on the site at the time of the order. The fixed amount of participation in the preparation and delivery costs will be communicated to the customer on the order summary, before the payment stage of the latter.


Article 3 - Customer and confidentiality

The customer, who declares to be a natural person of legal age or with parental consent, must ensure the accuracy of the information he/she provides to Moose Crossing SARL, in particular his/her delivery address, e-mail address and, if applicable, telephone number.

In the event that the purchaser enters his or her telephone number, Moose Crossing reminds the purchaser that he or she has the right to register on an opposition list to telephone canvassing.

The login (or e-mail address) and password that the customer enters when creating the order (when the customer chooses to create an account) constitute the customer's identification element, their entry having the value of a handwritten signature. All information collected by Moose Crossing SARL is strictly confidential, and will not be communicated to third parties unless expressly agreed by the customer.

For the ordering and delivery process, the customer agrees that email is the only means of communication between himself and Moose Crossing SARL.

Any customer who has previously been in dispute with Moose Crossing SARL (e.g., payment incident, excessive return request) may be denied processing of their order, which will be notified to them by email.


Article 4 - Ordering

The customer can only place an order by following the procedure provided for this purpose on the site, successively passing each of the steps that make it up. This procedure ends once the payment of the order is accepted by the service provider designated for this purpose by Moose Crossing SARL. The customer can check all the elements of the order (products, price, delivery rate, place and method of delivery, etc.) before entering his payment information. The customer cannot make the payment without having expressly accepted the general conditions of sale. The payment is made on the server of the service provider chosen by Moose Crossing SARL (Shopify Payments, Paypal or Stripe), no banking information (or payment card number, etc.) is entered or verified on a site edited by Moose Crossing SARL.
It is also possible for administrations and schools to make a payment by administrative mandate (contact us).

Once the payment is made or received, the customer is informed by email.

The order form is recorded on the servers used by Moose Crossing SARL. The customer agrees that it is considered as proof of the contractual relationship between Moose Crossing SARL and himself.

The invoice is sent by email.

Article 5 - Delivery - reception

Moose Crossing SARL will process the customer's order as quickly as possible, so as to transmit it in the best possible conditions to the service provider selected for delivery. The deadlines are understood in working days; the weekend, holidays, etc. not being any order placed for example on Friday or the weekend will be treated only the next working day.

At the reception of the order, the customer checks the conformity of the products received in execution of his order. Any anomaly concerning the delivery (i.e.: missing or damaged products, damaged packages) must be notified to Moose Crossing SARL's customer service department by one of the following means:

Moose Crossing SARL reserves the right to ask the buyer to return the non-compliant or damaged product. In case of abnormal or abusive returns, Moose Crossing SARL may refuse to serve a subsequent order.


Article 6 - Right of Withdrawal

The customer has a period of thirty (30) working days from the date of receipt of the goods to return, at the expense of Moose Crossing SARL and without reason, the product(s) he ordered. For the following product categories, the return shipping costs are at the customer's expense: wall maps, relief maps, large globes.

The customer then has a period of 14 days following the communication of his decision to withdraw to return his product(s) by one of the following means:

The product(s) must be returned in its (their) original packaging and wrapping, with the return form, to the physical address (located in metropolitan France) that will be communicated by email.

The responsibility of the buyer is only engaged with regard to the depreciation of the good resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of this good.

The buyer will be informed by e-mail within seven (7) days from the receipt of his return package, of the processing of his request. However, if the conditions are met, Moose Crossing SARL will reimburse the buyer the full amount of his order, within seven (7) days from the receipt by Moose Crossing SARL of the products.
Moose Crossing SARL will cover the cost of returning the item. Return postage will be handled as follows:
- either using a voucher prepaid by Moose Crossing SARL and provided in PDF format by email to the customer, who will affix it to the return package,
- or paid and stamped by the customer, who will be reimbursed by SEPA transfer, within 7 days after receiving the goods.

Article 7 - Data Processing and Liberties

The personal information collected by Moose Crossing SARL is only transmitted to third party service providers in the event that it is necessary for the processing of the order. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the customer has a right to access, rectify, oppose and delete data concerning him. The customer can exercise this right by writing to Moose Crossing SARL at its head office, 18 chemin de la Briqueterie 33160 Canéjan, France.


Article 8 - Intellectual Property

Any unauthorized reproduction or distribution of all or part of the elements and information of this site is prohibited, in particular for the photographs and excerpts of the maps available on the site, and the descriptions, titles and various elements attached to the products on sale on the site. The content is available for private and not collective use. The intellectual property code authorizes, under the terms of Article L. 122-5.2° and 3°a, on the one hand, only "copies or reproductions strictly reserved for the private use of the copier and not intended for collective use" and, on the other hand, only analyses and short quotations for the purpose of example and illustration, "any representation or reproduction in whole or in part without the consent of the author or his successors in title or assigns shall be unlawful" (art. L. 122-4). This representation or reproduction, by any means whatsoever, would therefore constitute an infringement punishable by articles L. 335-2 and following of the intellectual property code.
