Terms and Conditions of sale and legal information for the ‘Maps Company’ website, last updated on the January 15, 2015
The retail website named ‘Maps Company’ (hereafter referred to as the ‘site’) is an e-commerce site accessible via the internet, primarily at the web addresses mapscompany.com and www.mapscompany.com. The site is the exclusive property of Chromatic Enterprises Inc., who designs, develops, publishes and updates the site.
The site is powered by the open source platform WordPress, with the e-commerce plugin WooCommerce (WooThemes), and is hosted by Pagely.
The company Chromatic Enterprises Inc. is registered in New Brunswick, Canada under the number 811662139. Company headquarters are located at 67 rue du Havre – Petit-Rocher NB E8J 1H7 (New brunswick, Canada).
The site sells road maps, walking maps, travel maps, travel guides, books and accessories made by other companies (publishers or manufacturers) in printed or electronic (paperless) form. By placing an order for a product listed for sale on the website, the buyer accepts these terms and conditions of sale. The terms and conditions of sale in force are those listed on the site on the date the order is placed. These terms and conditions of sale are governed by canadian law and only canadian courts have juridiction for disputes. Chromatic Enterprises Inc. reserves the right to modify these terms and conditions of sale at any time by updating the site.
Article 1 – Products – Price
The only products available for purchase are those listed on the site on the day the customer views it. Products can only be delivered to countries and states / provinces listed on the delivery address form. Products and prices are valid while stocks last and as they appear on the site. The suggested delivery time provided for products that are not in stock is an estimate and is non-contractual. If products are out of stock, Chromatic Enterprises Inc. must buy products from wholesalers who themselves will require time to deliver the products. Product descriptions, specifications and photographs are produced with the utmost care possible taking into account the expertise of Chromatic Enterprises Inc. has available in order to provide the customer with the best possible information about the product (s) they wish to buy. Under no circumstances can Chromatic Enterprises Inc. be held responsible for the quality of the products, the effect of using the products or the impact of the delivery time. If the customer discovers that the products received do not match their order or their expectations they are granted a right of withdrawal (see below).
Prices indicated on the site are in canadian dollars (CAN) and are exclusive of taxes. The Taxes are applied according to the rules in force in Canada. Prices charged are those listed on the site at the time of ordering. The charge for preparing and delivering products will be communicated to the customer on their order summary form before the payment stage.
Article 2 – Customer
Customers must be adults aged 18 years or over otherwise they must have parental consent. The customer must ensure that the information they provide to Chromatic Enterprises Inc., in particular their delivery address and email address are correct. Chromatic Enterprises Inc. cannot be held responsible if a product is not delivered.
The customer’s ID is made up of the username (or the email address) and password the customer enters when they create their account. When entered, these details carry the same weight as a written signature. All information collected by Chromatic Enterprises Inc. is strictly confidential and will not be transferred to third parties unless the customer expressly provides consent.
The customer accepts that email will be the sole method of communication used between themselves and Chromatic Enterprises Inc. during the order and delivery process.
Any customer who has previously had a dispute with Chromatic Enterprises Inc. (e.g. payment incident, excessive amount of return requests) could have their order refused. They will be notified of this by email.
Article 3 – Order
Customers can only place orders by following all stages of the order process provided on the site in sequence. This process is completed once payment for the order has been accepted by the third party payment provider on behalf of Chromatic Enterprises Inc. The customer can check all parts of their order (products, price, delivery costs, delivery address and method etc.) before entering their payment details. The customer cannot make a payment without having expressly accepted the terms and conditions of sale. Payment is taken by the third party payment provider’s server (Stripe or Paypal) chosen by Chromatic Enterprises Inc.
The customer is informed by email once the payment has been processed or received.
The order form is stored on servers used by Chromatic Enterprises Inc. The customer accepts that the order form is considered evidence of a contractual relationship between Chromatic Enterprises Inc. and themselves.
The bill is sent by email or printed and sent when the goods are delivered.
Article 4 – Delivery – Receipt
Chromatic Enterprises Inc. will process the customer’s order as quickly as possible so that it can be promptly transferred to the selected third party courier. Delivery times are listed in working days. Working days do not include weekends and bank holidays e.g. orders placed at the weekend will not be processed until the following working day.
Delivery times listed on the website are only estimates and correspond with general delivery times. Delivery times are not contractual. Under no circumstances can Chromatic Enterprises Inc. be held responsible for the consequences of a longer than normal delivery time.
On receiving their order, the customer checks that the products received match their order. Any problems with the delivery (i.e. missing or damaged goods, damaged package) must be reported within 7 (seven) days of receiving the products to Moose Crossing SARL’s Customer Service department in one of the following ways:
– By writing a letter to Chromatic Enterprises Inc.’s headquarters (67 rue du Havre – Petit-Rocher NB E8J 1H7 – Canada)

– By filling in the contact form available by clicking on this link
Unless there is a good reason, any claims made 7 (seven) days after receiving products will be deemed inadmissible and Chromatic Enterprises Inc. cannot be held responsible. Chromatic Enterprises Inc. reserves the right to ask the customer to return the non-conforming or damaged product. If Chromatic Enterprises Inc. receives an irregular or improper return, they can refuse to send a replacement order.
Article 5 – Right of Withdrawal
The customer has seven (7) working days from the date the goods are received to return at their own expense the product(s) they have ordered without giving a reason. The product(s) must be returned in its original packaging along with the returns form to the following address: Chromatic Enterprises Inc. – Product returns – 67 rue du Havre – Petit-Rocher NB E8J 1H7 – Canada. If Chromatic Enterprises Inc. finds on receiving the returned package that the product(s) are not completely new (packaging and the product), Chromatic Enterprises Inc. can withhold the cost of returning the product to a brand new condition from the customer’s refund. The customer will be informed by email that their request has been processed within seven (7) days of their returned package being received. However, if the conditions for returning a product are met, Chromatic Enterprises Inc. will refund the customer for the full amount of their order within fifteen (15) days of the goods reception, excluding the cost of returning the products which the customer is responsible for paying.
Please note that refunds are made to the card used when placing the order. If the customer used a card with a deferred payment, the refund will be made at the end of the month.
Article 6 – Data Protection
Personal information collected by Chromatic Enterprises Inc. is only transmitted to third party service providers if necessary for processing an order.
Article 7 – Intellectual Property
Unauthorized reproduction or distribution of any or all elements and information contained on this site is forbidden, in particular photographs and map extracts available on the site. Content is available for private use only. Full or partial representation or reproduction is illegal without the consent of the author or those entitled to claim ownership or a right to the property (article L. 122-4). Representation or reproduction, by any means whatsoever, constitutes an infringement.
